What is workers' compensation?

California workers' compensation benefits are designed to provide you with the medical treatment you need to recover from illnesses or injuries due to workplace accidents. Benefits are available to partially replace the wages you lose while you are recovering and to help you return to work. Workers' compensation does not include damages for pain and suffering or punitive damages.

The system exists as a historic compromise between workers and employers — workers get treatment promptly rather than waiting through civil litigation, and employers avoid that litigation. The tradeoff only works when you have someone in your corner who knows the law.

This fund is designed to provide lifelong benefits for disabled workers who already had a disability or impairment before suffering a work-related injury. Not all lawyers delve into this niche area — it's a big part of my practice.

Under a California law effective July 13, 2026, the medical evidence needed for a SIBTF claim generally has to be gathered during your workers' comp case — not in a separate evaluation afterward.
