Client testimonial
Workers' Compensation · Anonymous

"Couldn't have worked with a more professional firm."

"From beginning to end, Dial and Associates kept me updated after every court appearance. I work full time and couldn't deal with the situation — they fought for the compensation I was entitled to."

Representative matter
SIBTF Claim

Lifetime benefits for workers whose pre-existing disabilities combine with a workplace injury.

Most firms don't pursue SIBTF claims. It's a core part of our practice — a potential source of additional, often lifelong, compensation.

Prior results do not guarantee a similar outcome.

§ 04 — Common Questions

What to expect, before you call.

Q·01 What does it cost to hire an attorney for a workers' comp claim? +
Nothing out of pocket. Attorney's fees in California workers' compensation cases are approved by the Workers' Compensation Appeals Board and deducted from your benefits once your claim resolves — typically between 9% and 15% of total benefits. You don't pay if we don't recover.
Q·02 I was injured at work but my employer didn't have insurance — now what? +
California law requires employers to carry workers' compensation insurance. When they don't, you may have a civil claim against the employer directly for medical expenses, lost wages, and damages. We'll advise on the right path.
Q·03 What is the SIBTF and am I eligible? +
The Subsequent Injury Benefits Trust Fund provides additional lifetime compensation to workers whose pre-existing disability combines with a workplace injury to produce significant permanent disability. It is rarely pursued and often overlooked. We handle it as a core part of the practice.
Q·04 ¿Hablan español? +
Sí. Dial & Associates is a fully Spanish-speaking law firm — Stephen and every staff member speak Spanish. Intake, hearing preparation, and settlement are handled in Spanish.
Q·05 How long do I have to file a claim? +
California generally imposes a one-year statute of limitations on workers' compensation claims, with important exceptions for cumulative trauma and occupational disease. The sooner you speak with counsel, the more options remain available.
